This website (the “Website”) is a website operated by Andaria Financial Services Limited and Andaria Financial Services UK Ltd (“AFSL”/ “we”/ “our”/ “us”).

In line with their current license standing, Andaria Financial Services Limited Malta and UK (“AFSL” or “the Group”) operate individually as:

  • a payment institution/service provider, serving companies (B2B) through the issuance of payment accounts and enabling global payments to companies and individuals via the open loop network of card schemes. (the “Customers”)

  • an e-money institution/EMI that issues e-money in its own right or in conjunction with other parties.

These Terms of Use govern your use of this Website and your relationship with AFSL.  Please read them carefully as they affect your rights and liabilities under the law (kindly refer to clause 8 below). If you do not agree to these Terms and Conditions, please do not register for our Services or use this Website.

1. General

1.1 The Website is provided to you free of charge and solely for your personal use, subject to these Terms of Use.  By using the Website you agree to be bound by these Terms of Use. References to these Website Terms of Use include our General Terms and Conditions and our Privacy Notice. The use of your data is governed by our Data Privacy Notice, and your purchase of our Services (within the meaning assigned to it in the General Terms and Conditions) from this Website is governed by our General Terms and Conditions.

1.2 These Website Terms of Use apply solely to your general use of the Website and any email correspondence between AFSL and you.

If we make any changes to these terms, we will let you know as soon as possible by posting the changes on the Website and updating the date below.  It is your responsibility to read these Terms on each occasion you use this website. If you do not wish to accept the new Terms of Use you should not continue to use the Website.  If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms of Use.

2.1  When entering the Website, you agree to not use the Website inappropriately or in contravention of any Maltese, UK and/or European legislation. You may not use the Website for any of the following purposes:

  • disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;

  • transmitting material that encourages conduct that constitutes a criminal offence, or otherwise breaches any applicable laws, regulations or code of practice;

  • interfering with any other person’s use or enjoyment of the Website; or

  • making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

2.2 You are responsible for the accuracy and veracity of any information you submit to the Website and you agree to keep any user credentials, password used on the Website or any other piece of information used as part of our security procedures confidential. You agree that AFSL will not be held responsible for any activity on the Website which results from access of a third party with or without your consent.

2.3 You will be responsible for our losses and costs resulting from your breach of this clause 2.

3. Availability and Maintenance of Website

3.1 AFSL reserves the right to change, suspend or discontinue the Website at any time, as well as, the right to impose limits on certain features and services or restrict your access to all or part of the Website without prior notice and without incurring any liability.

3.2  Although we undertake to offer you the best service possible, we make no promise that the services at the Website meet your requirements.  We cannot guarantee that the Website will be faultless.  If you would like to contact us regarding a fault in the Website, you may do so either by filling in the form on our Contact Us page on our website or by sending us an email on:

6.2 No licence is granted to you within these Website Terms of Use that allows you to use any trademark of AFSL. Trademarks used on the Website are the sole property of their respective owners and are protected by law.

6.3 When using the Website, you may not copy, reproduce, modify, transmit, distribute or commercially exploit or use any of the materials or content on the Website without prior written permission being granted from AFSL.

7. Disclaimer and Limitation of Liability

7.1 The content on the Website is provided for general information only, and although we make reasonable efforts to update the information, we make no representations, warranties or guarantees, whether express or implied, as to the operation of the Website or that the content on the Website is complete, accurate or up to date.

7.2 To the maximum extent permitted by law, AFSL shall not be held liable for any liability and responsibility emanating from the use, inability to use or the results of use of the Website for any amount or kind of loss, damage, expenses, costs or liability that you or any third party may suffer, including without limitation any direct, indirect or consequential loss or damage.

7.3 We do not guarantee that the Website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs and platform in order to access the Website. You should use your own virus protection software.

8. Law and Jurisdiction

8.1 The construction, validity and performance of these Website Terms of Use shall be governed by the Laws of Malta in respect of Andaria Financial Services Limited and by the laws of the United Kingdom in respect of Andaria Financial Services UK Ltd.

8.2 It is agreed that the Courts of Laws in Malta shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Website Terms of Use in respect of Andaria Financial Services Limited, whilst the Courts of England and Wales shall have exclusive jurisdiction in relation to Andaria Financial Services UK Ltd.
